Starting a New Job While Receiving Workers Compensation Benefits

There is nothing stopping a worker from starting a new job while still receiving compensation benefits from a former employer.

Before you read further:

Employers cannot refuse employment and treat workers who have had past claims unfairly. Workers are protected from this practise under the Workers Compensation Act (1951). If you experience any form of related mistreatment please contact the Injured Workers Service on (02) 8294 5181 or via this contact form and we can refer you to your relevant Union or towards legal support.

Employers are not required to ask you about previous claims or injuries and you are not obliged to tell them. However, honesty is the best way to approach these situations especially if it may impact your ability to perform the duties of the prospective role.

How could this affect medical treatment and related expenses?

A resignation does not impact your right to have reasonable medical expense reimbursed.

How this could affect weekly compensation benefits?

Getting a new job while receiving workers compensation can affect weekly benefit payments in different ways depending on the situation. Workers compensation payments are calculated according to pre-injury average weekly earnings and the hours you are working each week.

Contact the Injured Workers Service today for more support through this process on (02) 8294 5181 or via this contact form.
