Examiners are typically asked to identify any condition, whether it is temporary or permanent, and whether you can meet the inherent requirements (with or without reasonable adjustments). IME reports must respond directly to the questions posed, while remaining objective, evidence-based, and aligned with medico-legal standards. They want to confirm that your injury was caused or exacerbated by your work.

Standards of Independent Medical Examiners

An independent medical examiner is a medical specialist that has undergone medico-legal based training and accreditation to provide their medical opinion and is known as an expert witness. This means that they are bound by the Expert Witness Codes of Conduct and their duty is to the Court, not the individual being assessed or insurance company or the legal representative. Their role is to provide an unbiased, evidence-based opinion in line with current medical guidelines and legal standards.

What if the Examination Outcome is Not in my Favour?

If you’re unsatisfied with the IME or feel you’ve been treated unfairly, you can lodge a complaint or contest the report. If your decision reconsideration is again negative, you can take the case to the Administrative Review Tribunal for arbitration.
